HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.19668 OF 2016 ORDER:

The case of the petitioners is that the 1st petitioner is the absolute owner and possessor of the agricultural land admeasuring Ac.2.50 cents in Sy.No.100 and the 2nd petitioner is the absolute owner and possessor of the agricultural land admeasuring Ac.2.40 cents in Sy.No.100/1 having purchased the same by virtue of registered sale deeds bearing document numbers 3951/2012 and 3950/2002 respectively. Before the sale, the present land was assigned to one A.Ramachander who is the freedom fighter vide proceedings dated 18.10.2002 under freedom fighter quota and the then Tahsildar issued certificate dated 18.05.2011 stating that there is no objection for alienation of the said land, that as per G.O.Ms.No.1045 Revenue (Assn-1) Department dated 15.12.2004, the freedom fighter can alienate the land after elapse of 10 years.

In pursuance to the same, the family members of the freedom fighter executed the sale deed in favour of the petitioners and thus the petitioners became the absolute owners of the said property. When petitioners intended to sell the said lands, the Sub-Registrar informed them that the said lands, though not included in the prohibitory list, in column No.6/7 of pahanies it is shown as 'Laoni' patta and advised them to get the pahanies by deleting the word 'Laoni'. In pursuance to the same, the petitioners made an application dated 11.02.2016 requesting the 4th respondent to delete the word 'Laoni' in column No.6/7 of pahanies, who inturn vide proceedings dated 21.03.2016 requested the 3rd respondent to consider the case of the petitioners. But no action has been taken by the 3rd respondent so far.

Aggrieved by the same, the present writ petition is filed.

Heard both sides.

Since it is stated that in pursuance to the application made by the petitioners on 11.02.2016, the 4th respondent vide proceedings dated 21.03.2016 requested the 3rd respondent to consider the case of the petitioners, it is for the concerned authority to take appropriate action on the application of the petitioners. In view of the same, the competent authority is directed to dispose of the application of the petitioners in accordance with law within a period of eight (08) weeks from the date of receipt of copy of this order and communicate the same to the petitioners.

With the above direction, the writ petition is disposed of. There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 22-06-2016 dv
