HON'BLE SMT. JUSTICE LALITHA KANNEGANTI CRIMINAL PETITION No. 9560 OF 2021 O R D E R:

This Criminal Petition under Section 438 Cr.P.C. is filed by petitioner - Accused seeking bail in the event of his arrest in connection with Crime No. 8916 of 2021 on the file of A.P.T.S.Mahaboobnagar Police Station registered for the offence punishable under Section 135(1)(a) of Electricity Act, 2003. 2.

The case of prosecution is that on 28.10.2021, at the time of inspection, electricity connection is available to the premises of petitioner, but there is no meter. It is alleged that the beneficiary had directly tapped the electricity supply from nearby LT overhead line by means of white colour aluminium wire of about 15 meters length and connected to main switchboard on the premises, thus, he had involved in theft of energy violating the GTCS of TSSPDCL.

Learned counsel for petitioner Sri Gummadavelly Venkateswarlu submits that petitioner - accused is neither owner of the premises nor electricity connection is in his name. He further submits that though petitioner has falsely been implicated in this case, to prove his bona fides, he had paid already the outstanding amount of Rs.2,939/- and filed receipt in proof thereof, by way of a memo, before this Court. Hence, learned counsel submits that case of petitioner may be considered for grant of pre-arrest bail.

Taking into consideration the fact that petitioner has already paid the amount, this Court deems it appropriate to grant pre-arrest bail to him.

Accordingly, this Criminal Petition is allowed. Petitioner - Accused shall surrender before the Station House Officer, A.P.T.S. Mahaboobnagar Police Station in connection with Crime No. 8916 of 2021 within one week from today and on such surrender and executing a personal bond for Rs.20,000/- (Rupees twenty thousand only) with two sureties for a like sum each to the satisfaction of the said Station House Officer, he shall be released on bail. It is made clear that no further extension of time will be granted.
