HON'BLE SRI JUSTICE SURESH KUMAR KAIT & HON'BLE DR JUSTICE SHAMEEM AKTHER W.P. No. 8770 of 2017 O R D E R:- (ORAL) (Per Hon'ble Sri Justice Suresh Kumar Kait) In pursuance of the order dated 01.06.2017 passed by this Court, the learned Government Pleader for Education appearing on behalf of the respondents, submits that the Special Chief Secretary to Government issued Memo No.1217/ IE/ A1/ 2014, dated 17.06.2017 indicating that as per the Rules, misappropriation was already determined against the husband of the petitioner in the enquiry conducted by the Andhra Pradesh Backward Classes Co-operative Finance Corporation Limited way-back in 2010 itself for Rs.7,83,493/ -, as such, this amount has been ordered for recovery vide Government Memo No.1217/ IE/ A1/ 2014, dated 30.05.2017. Accordingly, the enquiry was closed. Consequently, the Regional Joint Director, Intermediate Education, vide Lr.Rc.No.3096/ C4/ PEN/ 2016, dated 19.06.2017 requested the Accountant General (A&E) to authorize the pension benefits in favour of the petitioner duly withholding the amount of Rs.7,83,493/ -.

It is pertinent to mention here that the petitioner' s husband retired from service on attaining the age of superannuation of 58 years on 31.01.2014 and expired on

SKK,J & Dr.SA,J WP_8770_2017 02.03.2014. Thus, the death abates criminal prosecution and disciplinary proceedings against the husband of the petitioner. Since the order dated 14.07.2015 in O.A.No. 3587 of 2014 passed by the Tribunal has been complied with, no further orders are necessary in this writ petition. Accordingly, the writ petition is closed. No order as to costs.

As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
