THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.25010 of 2018 ORDER:

Heard counsel for the petitioner, the Government Pleader for Excise appearing for respondents 1 & 2 and the Government Pleader for Home appearing for 3rd respondent. It is stated by counsel on both sides that the issue raised in this Writ Petition is covered by the order dt.20.12.2017 in W.P.No.43388 of 2017.

Therefore, for reasons alike, this Writ Petition is also disposed of directing the petitioner to make an appropriate application before the Deputy Commissioner of Prohibition and Excise, Warangal District (2nd respondent) enclosing thereto a Fixed Deposit Receipt for Rs.85,000/- (Rupees Eighty five thousand) drawn in favour of the 2nd respondent on any nationalized bank; and on such application being made by the petitioner, the subject stock i.e., 170 bags of black jaggery each containing 50 kgs seized in COR No.103 of 2018 on the file of 3rd respondent, shall be given to the interim custody of the petitioner. No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
