Petitioner submits that on promotion as Assistant Director of Mines and Geology, he was transferred and posted to Mahabubabad in erstwhile Warangal district. According to petitioner, he is suffering from chronic health problems and requires treatment, whereas no medical facilities are available in Mahabubabad town. Further, petitioner's wife is also working as Secondary Grade Teacher in Narketpally, Nalgonda district. Petitioner, therefore, seeks consideration for transfer to a suitable place.

Learned Assistant Government Pleader submits that ban on transfers is now in operation and the Commissioner for Industries Promotion & Mines Industries and Commerce Department (2nd respondent) and Director of Mines and Geology (3rd respondent) are not the competent authorities, and Government alone is competent. No representation was made to Government.

Having regard to these submissions, no direction as sought for can be granted at this stage.

Thus, it is open to petitioner to make a representation to the Government ventilating his grievance and placing before the Government the relevant material in support of his claim for shifting by relaxing ban. As and when such representation is made, the Government shall consider the request of petitioner objectively and take appropriate decision as warranted by law within a period of four weeks from the date of receipt of copy of this order.
