THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No. 1628 of 2006 ORDER:

When the matter is called, it is represented by the learned counsel for the petitioner that this matter is squarely covered by the Common Order of this Court in W.P.Nos.25076 of 2005 and 2306 of 2006. A copy of the said order is placed on record. It is not disputed by the learned counsel for the respondents.

2. Following the above referred judgment and for the reasons recorded therein, the writ is allowed, declaring that the respondents are not entitled to collect any market fees on the same notified agricultural produce for which the petitioner has already paid market fees to respondents 1 to 28 and the petitioner is entitled to claim setoff/adjustment of market fees, which was already paid to respondents 1 to 28. There shall be no order as to costs.
