THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.555 of 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against the petitioner/A-2 in C.C.No.13 of 2016 on the file of I Additional Special Judge for CBI Cases, Visakhapatnam arising out of Crime No.RC.09(A)/2005CBI/VSP registered for the offences punishable under Sections 13(2) read with Section 13 (1) (d) of Prevention of Corruption Act, 1988.

Heard and perused the material available on record. After arguing for sometime, the learned counsel for the petitioner, while not pressing for the main prayer, confined his arguments only to the extent of dispensing with the presence of the petitioner/A-2 before the trial Court.

In any event, considering the facts and circumstances of the case, the presence of the petitioner/A-2 before the trial Court is dispensed with except on the dates when his presence is specially required for the purpose of framing of charges and also for examination under Section 313 Cr.P.C. The petitioner/A-2 shall be properly represented by his counsel.

Accordingly, the Criminal Petition is disposed of.

Consequently, miscellaneous petitions, if any, pending, shall stand closed.
