HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.25310 OF 2017 O R D E R :

The case of the petitioner is that the 3rd respondent issued show cause notice dated 15.12.2016, on the ground that the petitioner was implicated in a criminal case, asking the petitioner to submit explanation as to why disciplinary action shall not be taken against him. Thereafter, the petitioner submitted explanation dated 22.12.2016 denying the allegations made against him. Subsequently, on 16.03.2017 the petitioner was acquitted in the said criminal case and he approached the 3rd respondent by submitting a representation dated 21.06.2017 to consider his claim by admitting into duties. Inspite of the same, the 3rd respondent neither passed any orders in pursuance to the show cause notice nor admitted the petitioner into duty. Aggrieved by the same, present writ petition is filed.

Heard learned counsel for the petitioner and learned Government Pleader for Home.

In view of the facts and circumstances, it is for the 3rd respondent to take action in pursuance to the show cause notice dated 15.12.2016 by taking into account the explanation filed by the petitioner and his subsequent acquittal in the criminal case. As such, the 3rd respondent is directed to pass orders after considering the explanation filed by the petitioner, in accordance with law,

within a period of eight weeks from the date of receipt of a copy of this order.

Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
