THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.11530 OF 2025 ORDER :

This criminal petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/A.4 seeking anticipatory bail in the event of his arrest in connection with Crime No.224 of 2025 of Raikal Police Station, Jagitial District. The offences alleged against the petitioner are under Sections 331(4) and 305(a) of Bharatiya Nyaya Sanhita, 2023.

The facts of the case are that on 13.08.2025 the defacto complainant lodged a report before police stating that between 12.06.2025 and 12.08.2025, she was not in her house and put the same under lock. During that period some unknown offenders entered into her house by breaking the door locks and committed theft of 1.5 tulas of gold necklace, half tula gold ear rings and two gold rings total worth of Rs.60,000/- and fled away along with booty. As such, requested the police to take necessary action. The police conducted investigation and arrayed A.1 to A.4 as accused in this case. A.1 to A.3 are

- 2 - already arrested and petitioner herein was shown as absconding.

Heard Sri M.Rathan Singh, learned counsel for the petitioner and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State. 4.

The contention of learned counsel for the petitioner is that petitioner herein is innocent of the said allegations. The police had already seized the stolen property from A.1 and nothing remains for seizure from this petitioner and there are no other cases pending against this petitioner. Further A.1 to A.3 are habitual offenders and as per the remand case diary also, the petitioner herein is no way connected with this offence. Hence, prayed this Court to grant anticipatory bail to the petitioner. 5.

On the other hand, learned Additional Public Prosecutor opposed bail stating that the confession statements of A.1 to A.3 shows that this petitioner also participated in the said crime on the relevant date. As such, requested this Court to dismiss this petition. He also submitted that there are no other cases pending against this petitioner.

Considering the submissions made by the respective counsel and the material on record, originally the case was registered against A.1 to A.3 and basing on their confession statement, the petitioner herein is arrayed as A.4. Even according to the remand case diary, the police had already seized the stolen property from A.1 and several cases are pending against A.1 to A.3 and no cases are pending against this petitioner. Considering the same, this Court deems it fit to grant anticipatory bail to the petitioner subject to the following conditions :

i.

The petitioner/A.4 shall surrender before the Station House Officer, Raikal Police Station, Jagitial District, within two weeks from today, and on such surrender, the said Station House Officer shall release the petitioner on bail on his executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, for the like sum each.

ii.

The petitioner/A.4 shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation and thereafter, as and when required.

iii.

The petitioner/A.4 shall abide by the other conditions stipulated in Section 482(2) of BNSS and co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
