HON'BLE SRI JUSTICE S. RAVI KUMAR CIVIL REVISION PETITION No.2752 of 2001 ORDER :

This revision is preferred against order dated 08.02.2001 in I.A.No.2544 of 2000 in O.S.No.21 of 1998.

2. The revision petitioner herein is plaintiff in the above referred suit O.S.No.21 of 1998 and respondents herein filed a petition under Order VI Rule 17 C.P.C. seeking amendment of written statement and the Court below allowed the said petition and permitted the proposed amendment. Questioning that, plaintiff preferred this revision. Though it is preferred in the year 2001, this Court neither admitted the revision nor passed any interim orders. Therefore, by this time, the suit in O.S.No.21 of 1998 must has been disposed of. As seen from the material, it appears there was a connected revision and it was dismissed on 29.07.2003. Considering these aspects, I am of the view that this revision is liable to be dismissed for non-prosecution.

3. Accordingly, this revision is dismissed for non prosecution.

4. Miscellaneous petitions pending, if any, shall stand closed. No costs.
