HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND HON'BLE SRI JUSTICE A. SHANKAR NARAYANA WRIT APPEAL No.992 OF 2016 JUDGMENT: (Per Hon'ble The Acting Chief Justice Ramesh Ranganathan) Heard Smt. S. Pranathi, learned counsel for the appellant, the learned Advocate General for the State of Telangana, and the learned Advocate General for the State of Andhra Pradesh. This appeal, under Clause 15 of the Letters Patent, is preferred against the interlocutory order passed by the learned Single Judge, in W.V.M.P. No.3271 of 2016 in W.P.M.P. No.31972 of 2016 in W.P. No.25873 of 2016 dated 20-09-2016, vacating the earlier interim order passed in W.P.M.P. No.31972 of 2016 dated 05-08-2016, and granting the appellant herein one month's time, from the date of the order, to vacate the subject quarter.

One month time, as stipulated in the order of the learned Single Judge, expired on 20-10-2016. We are saved the trouble of examining the order on its merits in view of the submission of Smt. S. Pranathi, learned counsel for the appellant, on instructions from the appellant, that the appellant would voluntarily and unconditionally vacate the subject quarter within four (04) weeks from today, and he would pay electricity and other charges, due and payable for the subject building, till he vacates the quarters. The learned Advocate General for the State of Telangana submits that, in view of the undertaking now given by the appellant, the order passed by respondent No.2 dated 29-06-2016, may be set aside.

HAC,J&ASN,J WA No.992 of 2016 the undertaking now furnished by the appellant, his continued possession of the subject quarter shall not be disturbed for a period of four weeks from today.

In view of the aforesaid submissions, the order of the learned Single Judge is modified, and the Writ Appeal is disposed of recording the undertaking of the appellant to voluntarily and unconditionally vacate the subject quarter within four (04) weeks from today. Consequently, in the light of the submission now made by the learned Advocate General for the State of Telangana, the order of respondent No.2 dated 29.06.2016 is set aside. No costs.

As a sequel thereto, Miscellaneous Application, if any pending, in the appeal, stand disposed of.
