THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5059 OF 2016 ORDER:

This petition is filed by the petitioner-accused under Section 482 Cr.P.C. seeking to quash the proceedings against him in Crime No.596 of 2016 on the file of Madhapur Police Station, (Guttula) Cyberabad, Hyderabad.

Heard and perused the material available on record. The offences alleged against the petitioner are punishable under Sections 427 and 336 IPC. The truth or otherwise of the said offences can be ascertained during investigation of the case. Therefore, this Court is not inclined to interfere with the investigation against the petitioner.

At this stage, the learned Counsel for the petitioner submitted that though the petitioner submitted explanation to the notice under Section 41 Cr.P.C., issued by the police, the police are harassing him by calling him every day to the police station and due to the pendency of the above crime, the petitioner apprehends arrest and harassment in the hands of the police.

In view of the above submission, the police concerned are directed to complete the investigation and file a final report, if any, without arresting the petitioner and also not to harass the petitioner by calling him to the police station, without there being any basic reason. With the above directions, the Criminal Petition is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed.
