THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY CIVIL MISCELLANEOUS APPEAL No.295 OF 2015 ORDER:

This Civil Miscellaneous Appeal, under Order 43 Rule 1 CPC, is filed challenging the order passed in I.A.No.53 of 2014 in O.S.No.21 of 2014 on the file of the Court of the First Additional District Judge, Nellore.

When the matter is taken up for hearing, the learned counsel for both parties submitted that pending the suit, the parties have settled the matter outside the Court. They further submitted that in pursuance of the settlement, the trial Court dismissed the suit on 20.04.2016.

In view of the submissions made by the learned counsel for both the parties, this Civil Miscellaneous Appeal is dismissed as infructuous. As a sequel, the miscellaneous petitions, pending in this Civil Miscellaneous Appeal, if any, shall stand closed. _____________________ T. SUNIL CHOWDARY, J.
