The petitioner/appellant was found guilty and convicted under Section 235(2) Cr.P.C.
in S.C.PCS.No.358 of 2022 dated 20.04.2023, for the offences punishable under Sections 9(m) read with Section 10 of the POCSO Act, 2012 and Section 354-A of Indian Penal Code. The petitioner was sentenced to undergo Rigorous Imprisonment for a period of five years for the offence punishable under Section 9(m) read with Section 10 of the POCSO Act, 2012 and also to pay a fine of Rs.1,000/-, in default of payment of fine to suffer Simple Imprisonment for a period of three months for the offence under Section 10 of the POCSO Act, 2012. In view of Section 42 of the POCSO Act, no separate sentence is being imposed against the petitioner/appellant for the offence under Section 354-A of Indian Penal Code.
Learned Counsel for the appellant submits that they have reasonable grounds to succeed in the appeal; and that the final hearing of the appeal may take considerable time and prayed this Court to suspend the sentence and enlarge the petitioner on bail.
This Court deems it appropriate to suspend the sentence of imprisonment only.
In the said circumstances, the sentence of imprisonment alone is suspended and the petitioner/ appellant/accused shall be enlarged on bail on his executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties for a like sum each to the satisfaction of the XII Additional Metropolitan Sessions Judge, Hyderabad (FAC: Fast Tract Special Court for the Trial of Cases under Protection of Children from Sexual Offences, Haca Bhavan, Hyderabad.
