THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.8399 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner who is arrayed as Accused in Crime No.1063 of 2022 pending on the file of Miyapur Police Station, Cyberabad registered for the offences punishable under Sections 417, 376(2)(n), 493 and 323 of Indian Penal Code. 2.

Heard learned counsel for the petitioner/Accused and the learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The case against the petitioner who is a student is that he and the victim exchanged messages on 'Hinge Dating App'. Thereafter they met in the month of February, 2022 and started chatting on mobile phone. The petitioner allegedly expressed his love for the de facto complainant. They also met and had sexual intercourse several times. However, the petitioner started avoiding the defacto complainant when she asked him to marry, for which reason, the complaint was filed.

Even according to the de facto complainant she is a major and user of Hinge Dating App and through that app she met the petitioner herein. Since the petitioner had refused to marry, she filed the present complaint. In the said circumstances, since the petitioner is in jail since 25.08.2022 and the material witnesses are already examined, he can be granted the relief of regular bail. 5.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused is granted bail subject to the following conditions:

i) The petitioner/Accused shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of VIII Additional Metropolitan Magistrate, Kukatpally.

ii) The petitioner/Accused shall appear before the concerned Station House Officer on every Monday between 10.30 AM and 01.00 PM for a period of eight (08) weeks or until filing of charge sheet whichever is earlier.

iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.
