THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.25241 of 2018 ORDER:

The only grievance of the petitioner in the present Writ Petition is non-disposal of the petition filed by the petitioner under Section 457 Cr.P.C., before the Deputy Commissioner of Prohibition & Excise, Chittoor/R.2 herein seeking release black jaggary in 40 gunny bags, each bag containing 40 Kgs., totaling 1600 KGs. On instructions, it is submitted by the learned Government Pleader that the said application filed by the petitioner in Cr.No.83 of 2018 on the file of the 3rd respondent is pending consideration before the Deputy Commissioner for Prohibition & Excise/R.2 herein. If that being so, this Court deems it appropriate to dispose of the Writ Petition, with a direction to the Deputy Commissioner for Prohibition & Excise/R.2 herein to verify the application, dated 04.07.2018, submitted by the petitioner herein and pass appropriate Orders, strictly in accordance with law, within a period of two weeks from the date of receipt of a copy of this Order. No order as to costs. Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
