THE HONOURABLE SMT JUSTICE K. SUJANA CRIMINAL PETITION No.11494 of 2025 ORDER:

This Criminal Petition is filed before this Court for grant of pre-arrest bail to the petitioner who is arrayed as accused No.20 in FIR No.39 of 2017 before the Bellampalli-I-Town Police Station, CID Regional Office, at Karimnagar District, registered for the offences punishable under Sections 420, 406, 120 (B) of IPC and Section 5 of AP Protection of Depositors and Financial Establishment Act-1999 and Sections 4, 5, (a), (c) of the Prize Chits and Money Circulation Schemes (Banning) Act-1978 and Section 38 (2) of the Telangana State Mutually Aided Co-Operative Societies Act1995. 2.

The case of the prosecution is that on 03-03-2017 at 22:00 hours, the de-facto complainant lodged a report before the police stating that, about two years ago the AEGIS Parivar Co-operative Society opened a branch at Bellampalli Rama Talkies area by deputing the accused Nos.1 to 46 as the agents of the same society and collated daily and month

deposits and not repaid the same after its maturity. Hence, he requested for taking necessary action. On receipt of the said complaint, the Police registered case against the petitioner for the offences as alleged. Aggrieved thereby, this Criminal Petition is filed seeking anticipatory bail of the petitioner.

Heard Sri G. Sundaresan, learned counsel for petitioner as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor appearing on behalf of the respondent - State. 4.

Learned counsel for petitioner submitted that the entire allegations are against the C.M.D., Directors and Regional Managers who have not paid the deposited amount to the customers and there is no specific overtact against the Petitioner/Accused No.20. It is further submitted that the petitioner himself is a victim of the offence committed by the company and its Directors and wife of petitioner is cited as witness and whose statement was also recorded. It is further submitted that the petitioner is a Government teacher and he is innocent of the alleged offences and has never committed any offence. Even according to the prosecution, no case is

established against this petitioner and the petitioner is not an agent. Therefore, he prayed the Court to grant pre-arrest bail to the petitioner by allowing this criminal petition. 5.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the allegations leveled against the petitioner are serious in nature. Further, the investigation was not yet completed. At this stage, granting of pre-arrest bail to the petitioner does not arise. Therefore, he prayed the Court to dismiss the criminal petition.

In light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner herein is shown as agent and the petitioner is arrayed as accused No.20, whereas, as per the statement of LW-63, who is a wife of the petitioner herein and she stated that her husband is a Government Teacher and she is an agent to the said company and no case is established against the petitioner herein. Considering the facts and circumstances of the case, this Court deems it fit to grant pre-

arrest bail to the petitioner, subject to compliance of the following conditions:

i.

The petitioner shall surrender before the Station House Officer, BellampalliI-Town Police Station, CID Regional Office, at Karimnagar District, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail, on petitioner executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties, for the like sum each.

ii.

The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioner shall appear before the concerned Investigating Officer on

every Monday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
