HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35589 of 2016 ORDER:

This writ petition is filed seeking to declare the action of respondents 4 & 5 in interfering with the civil dispute pending between the petitioners and respondents 6 & 7, as illegal and arbitrary.

Heard and perused the material available on record. The main grievance of the petitioners is that the respondents 6 & 7 made an attempt to dispossess the petitioners from their property and that the petitioners have made complaint, dated 07.10.2010, to the 5th respondent and complaint, dated 13.10.2016, to the 2nd respondent, but till now the 5th respondent is not registering the case against respondents 6 & 7 and he is interfering with the civil disputes between the petitioners and respondents 6 & 7.

Considering the grievance of the petitioners, the 5th respondent is directed to register a case against respondents 6 & 7 if the complaint lodged by the petitioner, dated 07.10.2016 and 13.10.2016, discloses any cognizable offence and investigate into the same and file a final report if any. If the petitioner is aggrieved by the action of the 5th respondent, he is at liberty to approach the superior officer of the 5th respondent and also to approach the concerned Court by invoking provision under Section 200 Cr.P.C. The 5th respondent is further directed not to interfere with the affairs of the petitioners and respondents 6 & 7, more particularly, with the civil disputes pending between them. However, this Order will not stand in the way of the 5th respondent to register a case, if

any complaint is lodged against the petitioners for cognizable offence.

Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ____________________ RAJA ELANGO, J Date: 21st October, 2016 KL
