THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.17892 OF 2017 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondent No.2 in passing the order vide Letter No.1/C12/01004/2017/HO/621, dt.18.05.2017 and Letter No.74619/04/09/2013/HO/621, dt.18.05.2017 revoking the building permission issued vide proceeding bearing PERMIT No.52996/HO/WZ/Cir-12/2016, dt.10.01.2017 and PERMIT No.1/C12/02712/2017, dt.26.03.2017 as illegal, arbitrary and violative of principles of natural justice and also in violation of Sec.450 of Greater Hyderabad Municipal Corporation Act, 1955 and consequently set-aside the above said proceedings Letter No.1/C12/01004/2017/HO/621, dt.18.05.2017 and Letter No.74619/04/09/2013/HO/621, dt.18.05.2017 issued by respondent No.2 and to pass such other order or orders as this Hon'ble Court may deem fit just and proper in the circumstances of the case."

The main grievance of the petitioner in this writ petition is that respondent No.2 passed the impugned order without considering its detailed explanation submitted on 24.04.2017. 3.

Considering the facts and circumstances of the case and the grievance of the petitioner, without going into the merits of the case, respondent No.2 is hereby directed to consider the explanation, dated 24.04.2017, of the petitioner and pass orders

afresh in accordance with law within a period of four (4) weeks from the date of receipt of a copy of this order after giving an opportunity of personal hearing to the petitioner. 4.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
