THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.18712 OF 2017 ORDER:

This Writ Petition is filed by the petitioner with the prayer which reads as follows:- "to declare the action of the respondents are not taking any action on the illegal construction of the 5th Respondent House which is obstructing to the petitioners main entrance, and also, surrounding the open nala of the neighbours of the petitioner, though, the petitioner approached all the official respondents, but, so far, no action has been taken and other side the 5th respondent completing the construction of his house, the said action of the respondents is highly illegal, arbitrary, unreasonable, discriminatory and also in violation of principles of natural justice and declare the same as bad in law and consequently direct the respondents to take immediate action against illegal construction of the 5th respondent house in Dharmapur Village, Mahaboobnagar Mandal, Mahaboobnagar District and to pass such other order or orders as this Hon'ble Court may deems fit just and proper in the circumstances of the case."

Heard learned counsel for the petitioner and learned Government Pleader for Panchayat Raj, representing the respondents 1 to 3 and 6 and recorded the offer of filing vakalat by Sri G.Narendar Reddy, learned counsel for the

4th respondent, before ordering notice to unofficial respondent No.5 and perused the material record.

The main grievance of the petitioner in the present writ petition is that the official respondents are not taking action against the 5th respondent for the unauthorized construction of the house, obstructing petitioner's main entrance. 4.

Having regard to the above, this writ petition is disposed of, directing the respondents to dispose of the representation dated 19.01.2017, said to have been submitted by the petitioner, within two weeks from the date of receipt of a copy of this order on own merits. Any further grievance of the petitioner, if any, is left open.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
