HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.12963 of 2017 ORDER:

Heard Mr.Bussa Rajendra for petitioner, the Assistant Government Pleader for Revenue and the Assistant Government Pleader for Home.

The petitioner prays for the following relief :- " ...... to issue a writ or order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not conducting survey for demarcation of petitioner's land to an extent of Ac.0.121⁄2 cents out of Ac.5.56 cents in Sy.No.521/ 1, vacant site situated at Bandamidakammapalle Village. Madanapalli Town & Mandal, Chittoor District with specific boundaries East: Bandi Bata, South & West: D Ramachandra Cultivation land, North: Road & Ramachandra's Land (at present Bye-pass Road) by considering the petitioner's representation dated 01.03.2017 is wholly illegal, arbitrary and violative of Articles 19 and 21 of Constitution of India and consequentially direct the respondents to conduct a survey for demarcation of petitioner's land to an extent of Ac.0.

12 1⁄2 cents out of Ac.5.56 cents in Sy No 521/ l, vacant site situated at Bandamidakammapalle Village, Madanapalli Town & Mandal, Chittoor District with specific boundaries East: Bandi Bata, South & West: D Ramachandra Cultivation land, North: Road & Ramachandra's Land (at present Bye-pass Road) by considering representation dated 01.03.2017 forthwith......"

The Assistant Government Pleader, on instructions, submits that the request for survey is rejected through endorsement, dated 01.03.2017.

In view of endorsement, Mr.Bussa Rajendra seeks liberty of the Court to challenge endorsement, dated 01.03.2017. He makes an ancillary submission namely, that there is no proof of service of endorsement on the petitioner.

I do not prefer to get into this polemic. The ends of justice are met the 4th respondent if is directed to send endorsement dated 01.03.2017 by registered post with acknowledgment due to petitioner within two months from the date of receipt of a copy of this order. Upon receipt of endorsement, the petitioner is given liberty to challenge endorsement in accordance with law. The writ petition is disposed of accordingly. No order as to costs.
