THE HONOURABLE SRI JUSTICE K.LAKSHMAN WRIT PETITION No.28550 OF 2019 O R D E R :

This writ petition is filed challenging the action of the respondents 2 and 3 in interfering with the peaceful possession and construction activity of the petitioner at Survey nos.333/2, 334/2, 338/2 and 340/2, admeasuring 80 Sq.Yards, situated at Weaker Section Colony, Gowdavelly Village, Medchal Mandal, Medchal-Malkajgiri District, without issuing any notice and without following due process of law, despite the construction permission granted by the Grampanchayat is in force. It is the case of the petitioner that she was granted patta in the year 2004 and thereafter she has obtained permission from 2nd respondent Gram Panchayat for construction of house on 13.03.2018 and the same is valid for two years. It is further stated that due to shortage of funds and financial problems, she has started construction now, and it is at the initial stage. The grievance of the petitioner is that despite there is valid permission for construction of house, the respondents 1 and 2 are interfering with the construction activity of the petitioner, illegally.

Heard both sides.

Sri K.Ramachandra Reddy, representing Sri G.Narender Reddy, learned Standing Counsel appearing for respondents 2

and 3 submits that they will follow procedure as per law and will not interfere with the construction activity being carried by the petitioner pursuant to the permission dated 13.03.2018 granted by the 2nd respondent; and that by giving liberty to the 2nd respondent-Gram Panchayat to take action against the petitioner in the event of any deviation in construction, the writ petition may be disposed of.

Granting the aforesaid liberty sought, this writ petition is disposed of directing the 2nd respondent-Gram Panchayat not to interfere with the construction being made by the petitioner in the subject property as per the permission granted by the 2nd respondent on 13.03.2018. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. ______________________ K.LAKSHMAN, J 24.12.2019 Note: Issue CC by 26-12-2019.
