THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.11466 OF 2025 ORDER :

This criminal petition is filed under Section 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioners/A.1 and A.2 seeking their enlargement on bail in connection with Crime No.414 of 2025 of Ramchandrapuram Police Station, Cyberabad. The offences alleged against the petitioners are under Sections 64, 69 and 351(2) of Bharatiya Nyaya Sanhita, 2023.

The case of the prosecution is that the defacto complainant lodged a complaint before police stating that she first met the accused, Mr. Mani Raman (A.2), on 10.06.2024 through a mutual friend, following which they developed friendship. During this period, A.2 expressed his love and promised to marry her. However, over a time, he revealed his true nature being addicted to drugs and alcohol, shorttempered, and a habitual womanizer. His younger brother, Mr. Mani Laxman (A.1), was also allegedly involved in these activities. The complainant stated that A.2 repeatedly subjected her to physical and mental abuse at his residence. She further alleged that he sexually assaulted her on multiple occasions without her consent, resulting in three pregnancies, and that

- 2 - she was coerced to undergo abortions under threats. She claimed that she was forced to cooperate due to blackmail and was also introduced to drug consumption against her will. On 20.04.2025, both A.1 and A.2 physically and sexually assaulted her at their residence. The complainant also stated that A.2 continued to threaten her with dire consequences if she attempted to file a complaint or disclose the incidents. Hence, the complainant requested the police to take necessary action against the petitioners. Basing on the said complaint, police registered the case against the accused for the said offences. 3.

Heard Sri K.Ram Murthy, learned counsel for the petitioners and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State. 4.

The contention of learned counsel for the petitioners is that petitioners are innocent of the said allegations and they have not committed any offence. As per the complaint the alleged offence took place in April 2025 but the complaint was lodged on 03.07.2025 i.e., two and half months after the offence. Petitioners are in jail from 18.07.2025 and material part of investigation is already completed. As such, requested this Court to grant bail to the petitioners.

On the other hand, learned Additional Public Prosecutor opposed bail stating that the alleged offences are heinous in

- 3 - nature and there is threat to the victim in the hands of petitioners. As such, prayed this Court to dismiss this bail application.

Considering the submissions made by the respective counsel and the material placed on record, according to the victim, she was introduced to A.2 in the year 2024 and from then onwards they are acquainted with each other. Further, the commission of offence is in April, 2025 and report was lodged after two and half months of the incident, due to the threats of the accused. However, petitioners are in jail from 18.07.2025 and as seen from the record 11 witnesses were already examined by the investigating officer including the investigating officer. Considering the same, this Court deems it fit to grant bail to the petitioners subject to the following conditions : i.

The petitioners/A.1 & A.2 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), each with two sureties for a like sum each to the satisfaction of II-Additional District & Sessions Court, Sangareddy.

ii.

The petitioners/A.1 & A.2 shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation and thereafter, as and when required.

iii.

The petitioners/A.1 & A.2 shall abide by the conditions stipulated in Section 483(2) of BNSS.

The petitioners/A.1 and A.2 are directed not to harass or threaten the victim.

Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
