Mr. Manyam Sri Rama Venkata Surya Narayana Murthy v. The State Of Telangana

THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No. 508 OF 2017 ORDER:

This petition is filed under Section 438 of the Code of Criminal Procedure (for short, 'Cr.P.C.') to enlarge the petitioner on pre-arrest bail in crime No. 165 of 2016 of Medak Rural Police Station, Medak District, for the offence punishable under Sections 406, 409 and 420 of the Indian Penal Code apprehending his arrest in connection with the above crime.

After arguing the matter for awhile, Sri M.V.Hanumantha Rao, learned counsel for the petitioner, requested this Court to direct the investigating agency to consider his reply to the notice issued under Section 41-A of Cr.P.C. and the guidelines issued by the Apex Court in Arnesh Kumar Vs. State of Bihar and another1.

Acceding to the request of learned counsel for the petitioner, it is appropriate to direct the investigating agency to consider the reply and any other material annexed to the reply to the notice under Section 41-A of Cr.P.C. and strictly adhering to the guidelines issued by the Apex Court in Arnesh Kumar (supra).

With the above directions, the criminal petition is disposed of. Pending miscellaneous petitions, if any, in this criminal petition shall stand closed in consequence.
