THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.21956 of 2011 ORDER:

This writ petition was filed challenging the action of respondent No.2 in not referring the award to the Civil Court under Section 18 of the Land Acquisition Act. It is the case of petitioners that their agricultural lands were acquired by the respondents for the purpose of Ayacut under Lift Irrigation Scheme from Giramma Tank of Right Main Canal of Yerracalva Reservoir Scheme. The lands are situated in Kamavarapukota Sub-Registry, Kamavarapukota Mandal, Tadicharla Village, West Godavari District. Now a counter affidavit is filed stating that an award was passed on 10.01.2007 fixing Rs.46,000/- per acre along with other benefits under Section 11(1) of the Land Acquisition Act. The amount was paid to the awardees on 31.03.2007 and they have taken the amount under protest.

In view of the same, the award was referred to the Court of Additional Senior Civil Judge, Eluru by proceedings dated 02.02.2008 and L.A.O.P.Nos.111/2008 and 112/2008 are pending before the Court of Additional Senior Civil Judge, Eluru. In view of the same, no further relief can be granted in the present writ petition.

At this stage, learned counsel for the petitioners submits that in view of pendency of the L.A.O.Ps since 2008, appropriate direction shall be given to the learned Additional Senior Civil Judge, Eluru for disposing of those L.A.O.Ps as expeditiously as possible.

In the circumstances, while closing this Writ Petition the learned Additional Senior Civil Judge, Eluru, before whom the L.A.O.P.Nos.111/2008 and 112/2008 are pending, is directed to dispose of the said O.Ps as expeditiously as possible, but not later than six (6) months from the date of receipt of a copy of this order. No order as to costs. Miscellaneous Petitions pending, if any, shall stand closed.
