HONOURABLE JUSTICE G. SRI DEVI I.A.No.1 of 2019 In/and CRIMINAL PETITION No.7556 of 2018, CRIMINAL PETITION No.13392 of 2014 AND WRIT PETITION No.28363 of 2014 COMMON ORDER:
1) Criminal Petition No.7556 of 2018 is filed by accused No.1 and Criminal Petition No.13392 of 2014 is filed by accused Nos.2 and 3 in C.C.No.20 of 2014 on the file of the Judicial First Class Magistrate, Siddipet, Medak District, to quash the proceedings in the above C.C. A charge sheet came to be filed against the petitioners for the offences punishable under Sections 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961. 2) Writ Petition came to be filed by the second respondent in both the Criminal Petitions along with others, seeking a declaration that the action of the second and third respondents therein in pressurizing the petitioners through the fourth respondent on the basis of F.I.R.No.
111 of 2014, to compromise with the fifth respondent by withdrawing all the complaints made against the fifth respondent and his family members and to give divorce by mutual consent to the fifth respondent as illegal and arbitrary. 3) Since the issue in all the matters is interconnected, all these petitions are disposed of by this common order. 4) During pendency of those proceedings, I.A.No.1 of 2019 came to be filed in Crl.P.No.7556 of 2018 to record the compromise.
that at the intervention of elders and well wishers, the parties have settled their disputes in terms of the compromise. The said joint memo has been supported by the affidavit of the second respondent.
5) Today, both the parties are present before this Court and they were identified by their respective counsel. This Court, when examined, both the parties have stated that at the instance of the elders, they have settled the matter out of the Court and a Memorandum of Understanding also entered into between the parties and the second respondent in both the Criminal Petitions has no objection for quashing the proceedings against the petitioners.
6) In the light of the compromise arrived at between the parties, the compromise memo filed by both the parties is recorded and I.A.No.1 of 2019 is ordered.
7) Accordingly, both the Criminal Petitions are allowed in terms of compromise, and the proceedings in C.C.No.20 of 2014 on the file of the Judicial First Class Magistrate, Siddipet, Medak District, against the present petitioners are hereby quashed. Likewise, Writ Petition is also disposed of in terms of compromise. The Memorandum of Understanding do form and part of this order.
