HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.25032 of 2018 ORDER: (ORAL) (Per Suresh Kumar Kait, J) Vide the present writ petition, petitioners have assailed order dated 13.07.2018 passed in O.A.No.1365 of 2018 by the Andhra Pradesh Administrative Tribunal, Hyderabad, whereby the application filed by the petitioners under Section 19 of the Administrative Tribunals Act, 1985 has been dismissed by holding that if the petitioners did not file any appeal questioning the final seniority list dated 20.02.2018, they are at liberty to file appeal, subject to the period of limitation. 2.

Learned counsel appearing on behalf of the petitioners submits that provisional seniority list was issued on 09.02.2018 and objections were sought from the petitioner and similarly situated employees. Accordingly, petitioners filed objections on 12.02.2018 and they were sent by the Officer Commanding, HQ Coy, 6th Bn., APSP, Mangalagiri to the Commandant, 6th Bn., APSP, Mangalagiri on 19.02.2018. 3.

The said objections were not considered as is evident from the order dated 20.02.2018, wherein it is stated that none of the personnel have submitted their objections/representation so far; hence, the seniority/placement of the personnel which was shown in seniority list is confirmed.

Since final seniority list has been issued on 20.02.2018, we hereby grant liberty to the petitioners to file appeal against the same within a

SKK, J & AKS, J W.P.No.25032 of 2018 period of fifteen (15) days from today. In such an event, the appellate authority shall consider the same within two weeks from the date of receipt of the appeal to be filed by the petitioners and pass appropriate orders. Till such time, the respondents shall not give effect to the final seniority list dated 20.02.2018.
