HONB'E SRI JUSTICE CHALLA KODANDARAM WRIT PETITION No.13529 OF 2017 ORDER:
The writ petition is filed challenging the action of the respondent authorities in issuing the notice dated 15.2.2017 under Sections 452(1) and 461 of Hyderabad Municipal Corporation Act, 1955. The allegations made in the impugned notice are that the petitioner is running a poultry form and to that effect a complaint has been made by the 5th respondent to the respondent authorities. Learned standing counsel for the 2nd respondent, on instructions, submits that taking into consideration of the averments made in the writ affidavit, the officials of the Corporation have inspected the premises of the petitioner and they have found that certain poles have been erected for the purpose of construction. However, on inspection, they find that there is no poultry form that being run by the petitioner.
Considering the fact that the constructions which have been made by the petitioner are being objectionable and when a notice has been issued to the petitioner, petitioner has to submit his objections and as and when such objections are filed, the same shall be considered by the respondent authorities within a period of four weeks from the date of receipt objections. Till such time final orders are passed on the objections filed by the petitioner, no coercive steps shall be taken against the petitioner including the demolition.
With the above observations, the writ petition is disposed of. No order as to costs.
Miscellaneous petitions, if any pending in this writ petition shall stand closed.
