This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking pre-arrest bail to the petitioner who is arrayed as Accused in the event of his arrest in Crime No.143 of 2022 on the file of Station House Officer, Gambhiraopet Police Station, Rajanna Sircilla District registered for the offence 307 of Indian Penal Code.

Heard the learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The de facto complainant lodged a complaint alleging that while he was discussing certain issues with Panchayath Secretary in the Grampanchayath, the petitioner allegedly went into the said premises and poured kerosene on the de facto complainant. Even according to the complaint there are certain disputes with regard to the property and the de facto complainant apprehended that this petitioner may kill him at any time.

Keeping in view that there are civil disputes in between the petitioner and de facto complainant and also the fact that no injuries
Crl.Petition No.8392 of 2022 are caused to de facto complainant, the petitioner who is a woman can be granted relief on anticipatory bail.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused is granted anticipatory bail subject to the following terms and conditions:
i) The petitioner/Accused is directed to surrender before the Station House Officer, Gambhiraopet Police Station, Rajanna Sircilla District within one week from today, and on such surrender, he shall be enlarged on bail on his executing personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand Only) with two sureties to the like sum each, to its satisfaction.
ii) The petitioner/Accused shall appear before the investigating authorities as and when required.
iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 438(2) Cr.P.C.
