THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO CRIMINAL APPEAL No.185 of 2014 JUDGMENT:

The learned counsel for appellant seeks to withdraw this appeal, which has been filed under proviso to Section 372 Cr.P.C., since he has realized that the appellant would not be entitled to the benefits of the said proviso since the incident in question has taken place before 3112-2009. The learned counsel for appellant, however, seeks leave of the Court to withdraw this appeal with liberty to file appeal under Section 378(4) of Cr.P.C. Therefore, granting leave as sought, this appeal is dismissed as withdrawn. No costs.

As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
