O R D E R
(per Hon'ble Sri Justice Sanjay Kumar) This Court has time and again refused to entertain writ petitions filed against the orders of the Andhra Pradesh Administrative Tribunal, Hyderabad, either admitting an OA or ordering notice before admission and inviting a counter. In the present case also, by order dated 17.08.2016 passed in O.A.No.3181 of 2016, the Tribunal admitted the case and ordered notice to the respondents returnable in six weeks. However, Sri G.V.Shivaji, learned counsel for the petitioners/applicants, would contend that despite the interim order granted by this Court in W.P.No.20089 of 2016, which would cover the interim relief in the O.A., being shown to the Tribunal, the said order was not followed.
No doubt, interim orders are not binding but the Tribunal is bound to take note of the orders passed by this Court, be it at the final or at the interim stage, if such orders have an impact on the issues arising before the Tribunal in the subject O.A. and more particularly, the interim relief sought. We are of the opinion that the interests of justice would be sufficiently served by permitting the petitioners/applicants to move the Tribunal again for appropriate interim relief in the event the order passed by this Court in W.P.No.20089 of 2016 has a bearing on the same. Subject to the above observation, the writ petition is dismissed. The petitioners/applicants are at liberty to move the Tribunal for appropriate interim relief in terms of this order.
Pending miscellaneous petitions shall also stand dismissed. No order as to costs.
