HON'BLE SMT. JUSTICE LALITHA KANNEGANTI CRIMINAL PETITION No.9505 of 2021 O R D E R:

This Criminal Petition under Sections 437 and 439 Cr.P.C. is filed by petitioner - Accused No.5 in Crime No.224 of 2021 on the file of Kethepally Police Station, Nalgonda District, registered for the offence punishable under Section 8(c) read with Section 20(b)(ii)(c) of Narcotic Drugs and Psychotropic Substances Act, 1985, seeking bail. 2.

The case of prosecution is that on 30.09.2021 at 08.30 hours, on credible information, the Sub-Inspector of Police along with his staff stopped a bus bearing No.AR-01T-1234, which was coming from Visakhapatnam to Hyderabad, found the accused in possession of ganja and seized 20 kgs of ganja from the possession of petitioner under a cover of panchanama.

Learned counsel for petitioner Sri Palle Sriharinath, submits that the contraband of 20 kgs seized from the possession of petitioner is not a commercial quantity and as petitioner was arrested and remanded to judicial custody on 20.10.2021, her case may be considered for grant of bail.

On the other hand, learned Assistant Public Prosecutor submits that the petitioner belongs to Visakhapatnam, State of Andhra Pradesh, and as the investigation is pending, she is not entitled for bail. However, he does not dispute the fact that petitioner has no criminal antecedents.

Taking into consideration the fact that contraband seized in this crime is 20 kgs, which is not a commercial quantity and as petitioner is languishing in jail since 20.10.2021, and also there is nothing

forthcoming to show that petitioner has criminal antecedents, this Court deems it appropriate to grant bail to her, however, on certain conditions. 6.

The Criminal Petition is therefore, allowed. Petitioner - Accused No.5 shall be enlarged on bail in connection with Crime No.224 of 2021 on the file of Kethepally Police Station, Nalgonda District, on her executing a personal bond for a sum of Rs.75,000/- (Rupees seventy five thousand only) with two sureties for a like sum each to the satisfaction of the Judicial First Class Magistrate at Nakrekal, Nalgonda District.
