Heard.
The petitioner had earlier approached this Court in W.P.No.11599 of 2013 and by order dated 24-04-2013 in W.P.M.P.No.14371 of 2013 in W.P.No.11599 of 2013, respondents 2 to 4 herein are directed not to interfere with the petitioner's possession.
So far as third parties are concerned, the petitioner states that he has already filed a civil suit in O.S.No.275 of 2014 before the Principal Junior Civil Judge, Anantapur. Since the interim order in the earlier writ petition is already subsisting, the present writ petition filed by the same petitioner making similar allegations against respondents 4 and 5 herein is totally unnecessary as respondents 2 to 4 herein are already restrained by the aforesaid order and the earlier writ petition is pending. It is stated that no counter affidavit is filed in the earlier writ petition i.e., W.P.No.11599 of 2013. Learned Government for Revenue shall therefore take steps to file counter in the said writ petition at the earliest. In the circumstances, I find that the present writ petition is wholly unnecessary as it filed for the self same allegations, which are subject matter of earlier writ petition referred to above.
Hence, the writ petition is dismissed. No order as to costs. The miscellaneous petitions, if any, pending in this writ petition shall stand closed. _______________________ VILAS V.AFZULPURKAR, J Date: 05-06-2015 Prv
