Heard.
The petitioner states that though the 3rd respondent has registered the sale deeds executed by him, he has given pending Nos.3412 and 3413 to the said documents and the same were not released. Therefore, the petitioner filed W.P.No.23096 of 2015 and this Court by order dated 03-08-2015 disposed of the said writ petition directing the 3rd respondent to communicate the reasons to the petitioner as to why the documents are kept pending. Pursuant thereto, under the letter, dated 01-09-2015, the 3rd respondent informed the petitioner that the SubRegistrar, Ibrahimpatnam, rejected the documents in question, as the land admeasuring Ac.0-21 cents is classified as assigned land as per the updated list sent by the 6th respondent on 22-11-2012.
The petitioner, thereafter, made a representation before the 6th respondent under the Right to Information Act and the 6th respondent issued Endorsement on 22-09-2015 informing that the information asked for by the petitioner is not available in the office of the 6th respondent. The present writ petition is filed seeking a Mandamus. I am unable to see any reason to grant Mandamus by entertaining the writ petition, inasmuch as the land claimed by the petitioner is included in the prohibited list cannot be denied as per the letter addressed by the 3rd respondent to the petitioner, referred to above. Merely because the 6th respondent informed the petitioner under the Right to Information Act that the information sought for is not available in the office does not entitle the petitioner to seek registration of the documents.
The relief sought for is clearly misconceived. However, it is open to the petitioner to seek deletion of the said land from the prohibited list by making appropriate application before the competent authority.
Accordingly, the writ petition is dismissed. No costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. _______________________ VILAS V.AFZULPURKAR, J Date: 06-10-2015 Prv
