The father of the petitioner died on 23.11.1995 while he was in service. Petitioner claims appointment on compassionate grounds. Petitioner says that earlier his brother field Writ Petition No. 26095 of 2000 and the said Writ Petition was disposed of by an order dated 4.8.2008 directing consideration of the representation submitted. Alleging inaction on the said representation, this Writ Petition was filed.

A bare perusal of the averments made in the affidavit filed in support of the Writ Petition and the declaration of the age of petitioner would show that the petitioner was aged about 2 to 3 years when his father died. The appointment on compassionate grounds is not a continuous right vested in any dependent. The very concept of compassionate appointment is to provide immediate succor to the family on account of sudden death of bread winner putting the family into turmoil causing hardship to the family. The fact remains that the family has survived such a long time would mitigate against such a claim. Though some ray of hope was created consequent to the directions issued by this Court in W.P.No. 26095 of 2000, nine years after the Writ Petition was disposed of this Writ Petition is filed. Having regard to the fact that the death of the father was in the year

PNR,J W.P.NO. 13329 OF 2017 1995 and the petitioner was aged about 2 to 3 years at that time, the claim in the Writ Petition to grant appointment on compassionate grounds cannot be granted and the Writ Petition is liable to be dismissed.

Accordingly, the Writ Petition is dismissed. There shall be no order as to costs. Miscellaneous Petitions, pending if any, shall stand closed.
