HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

Petitioner was appointed as Contract Junior Lecturer in Office Assistanceship (Vocational) on 20.11.2000 and continued to work upto September, 2009. According to petitioner, he suffered with viral fever and later it was identified as Chickengunia and typhoid and Doctors advised him to take rest for 45 days. After recouping from ailment, when he approached the Principal of the College, he was not allowed to join duty holding that somebody else was already appointed in his place. Petitioner claims that he made representation for reappointment and challenging inaction earlier O.A.No.5101 of 2015 was filed before the Andhra Pradesh Administrative Tribunal. The Administrative Tribunal disposed of the said O.A., on 03.09.2015 directing consideration of his request. Alleging inaction on such consideration and that he is not reappointed, this writ petition is filed.

It is clear from the reading of facts as averred in the affidavit filed in support of writ petition, the last engagement of petitioner was in September, 2009 and his appointment all along is contractual appointment for one year, renewed from year to year. 3.

As submitted by petitioner, in his place, somebody else was already appointed. If that being so, there cannot be any reappointment of petitioner merely because he worked earlier. No direction as sought for can be granted. However, it is open to petitioner to participate in the selection process that may take place for recruitment on contract basis subject to suitability.
