THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.10006 OF 2015 ORDER :

This writ petition is filed seeking writ of mandamus declaring the action of the respondents in deleting the names of the petitioners from the eligible list of pensioners of Chinnapavani Grampanchayath, Lingasamudram Mandal, Prakasam District and stopping amount to the petitioners as illegal and arbitrary and consequently to direct the respondents to pay the pension amount due to the petitioners in terms of G.O.Ms.No.113 PR & RD (RD-I) Department dated19.06.2014 and G.O.Ms.No.135, PR & RD (RD-I), Department dated 17.09.2014.

The grievance of the petitioners is that they have been granted pensions under Society Security Pension Scheme for the last seven years and now abruptly their names have been deleted by the respondent authorities and pensions have been stopped from September, 2014. It is stated that when representation is made, no action is being taken on the same by the respondent authorities. It is stated that they have also filed an appeal before the 5th respondent on 09.03.2015, but no orders have been passed so far. Aggrieved by the same, the present writ petition is filed. Heard Sri I.Gopala Reddy, learned counsel for the petitioners as well as Sri G.Seshadri, learned Standing Counsel for the respondents 5 and 6. Since the appeal filed by the petitioners on 09.03.

2015 is pending before the 5th respondent, the 5th respondent is directed to dispose of the same within a period of four (4) weeks from the date of receipt of a copy of this order. If the order granting pension is valid and subsisting, the respondents are directed to pay the pension to the petitioners. If the appeal filed by the petitioners is not disposed of within the time stipulated, they have to restore pension to the petitioners till the appeal is disposed of. However, this will not preclude the competent authority from taking action, if pension is granted in violation of the Rules in force.

With the above direction, this writ petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 09.04.2015 kvs
