THE HONOURABLE SMT JUSTICE K. SUJANA CRIMINAL PETITION No.11477 of 2025 ORDER:

This Criminal Petition is filed before this Court for grant of pre-arrest bail to the petitioners who are arrayed as accused Nos.1 to 3 and 12 in Crime No.367 of 2025 before the Medak Town Police Station, at Medak District, registered for the offences punishable under Sections 109, 333, 189 (2), 191 (3) r/w section 190 of BNS Act, 2023.

The case of the prosecution is that on 02-09-2025 at 13:40 hrs, the de-facto complainant lodged a report before the police stating that there are business disputes between the de-facto complainant and the accused No.1. When the de-facto complainant demanded his money back, the accused No.1 had planned to kill him. On 01.09.2025, the de-facto complainant along with his friends went to Hyderabad for some work and returned to Medak on 02.09.2025.

On seeing the de-facto

complainant, they all criminally trespassed into his house and attacked him with sticks and iron rods with an intention to kill him and he escaped from the same. Hence, he requested for taking necessary action. On receipt of the said complaint, the Police registered case against the petitioners for the offences as alleged. Aggrieved thereby, this Criminal Petition is filed seeking anticipatory bail of the petitioners.

Heard Sri Ponnam Ashok goud, representing on behalf of Gundaram Manoj Goud, learned counsel for petitioners as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor appearing on behalf of the respondent No.1- State.

Learned counsel for petitioner submitted that there is no such attempt made by the petitioners herein and the petitioners are innocent of the said alleged offences and there are falsely implicated in this case. It is further submitted that there are only business disputes between the petitioners and the de-facto complainant. Therefore,

he prayed the Court to grant pre-arrest bail to the petitioners by allowing this criminal petition. 5.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioners stating that the allegations leveled against the petitioners are serious in nature. It is further submitted that the custodial interrogation of the petitioners is required. It is further submitted that accused Nos.4 to 11 were already arrested and are absconding. Further, the investigation was not yet completed. At this stage, granting of pre-arrest bail to the petitioners does not arise. Therefore, he prayed the Court to dismiss the criminal petition.

In light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that there are business disputes between the petitioners and the de-facto complainant and accused Nos.4 to 11 were already remanded to the judicial custody. Considering the facts

and circumstances of the case, this Court deems it fit to grant pre-arrest bail to the petitioners, subject to compliance of the following conditions:

i.

The petitioners shall surrender before the Station House Officer, Medak Town Police Station, at Medak District, within two weeks from today, and on such surrender, the said Station House Officer shall release them on bail, on petitioners executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties, for the like sum each.

ii.

The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-

operate with the Investigating Officer in investigating the case.

iii.

The petitioners shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
