THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.706 OF 2017 ORDER:

This petition is filed under Section 438 of Criminal Procedure Code (for short "Cr.P.C.") for grant of pre-arrest bail to the petitioners, in the event of their arrest in Crime No.33 of 2017 of Ghatkeshwar Police Station, Rachakonda District, registered for the offences punishable under Sections 498-A and 506 of Indian Penal Code (for short "I.P.C.") and Sections 3 and 4 of the Dowry Prohibition Act (for short "D.P.Act").

After arguing the matter, learned counsel for the petitioners requested to permit the petitioners to surrender before the concerned Court and on such surrender, the Court may decide the bail application on the same day.

Acceding to the request of the learned counsel for the petitioner and considering the material available on record, I deem it appropriate decide the criminal petition without touching the merits. Accordingly, the petitioners are permitted to surrender before the XIII Metropolitan Magistrate, Cyberabad at L.B.Nagar and on such surrender, the concerned Court is directed to decide the application for bail if any filed on the same day, subject to giving notice to the learned Public Prosecutor and on hearing the argument of learned Public Prosecutor.
