THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 46709 of 2016 ORDER:

This writ petition was filed challenging the action of respondent No.4 in interfering with the petitioner's rights in respect of agricultural land, admeasuring Ac.1.00 in Survey Nos.8/A, B, and C and premises bearing No.8-31/1, situated at Peddamaduru Village, Davaruppula Mandal, Jangam District.

Respondent No.4 filed a counter-affidavit stating that respondent No.5, who is the elder brother of the petitioner, approached the Police by lodging a complaint on 14.12.2016 against the petitioner. In the complaint, it is stated that respondent No.5 is having house in Peddamaduru Village and when he went to the said house on 13.12.2016, he found that the samans in the house are in pell-mell condition and some chairs were broken. The said complaint was entered in the Station General Diary on 14.12.2016. Thereafter, the petitioner also lodged a complaint on 17.12.2016 against respondent No.5 and on the same day, an entry was made in the Station General Diary. During the course of preliminary investigation, it came out that the dispute between the petitioner and respondent No.5 is civil in nature.

In view of the above, no relief can be granted by this Court in the present writ petition and it is left open to the parties to work out their remedies in appropriate proceedings.

The writ petition is accordingly closed.
