THE HONOURABLE SRI JUSTICE M.S. RAMACHANDRA RAO Writ Petition No.28553 of 2019 ORDER :

Heard the counsel for petitioners, the learned Government Pleader for Housing, for 1st respondent, and the learned Government Pleader for Revenue, for respondent nos.2 to 5. 2.

The petitioners herein have submitted an objection on 17.12.2019 to 4th respondent who is the Nodal Officer for allotment of houses under the 2 BHK Scheme of the Government of Telangana, contending that ineligible persons are being allotted 2 BHK houses under the said Scheme framed by the State Government, and persons who already own houses are also being allotted 2 BHK houses. 3.

The petitioners further contend that the 4th respondent herein should be directed to decide the said objections as was done in the order dt.29.11.2019 passed in Writ Petition No.24802 of 2019, and till such objections are disposed of by 4th respondent no such allotment should be made.

The learned Government Pleader for Revenue, appearing for respondent nos.2 to 5, also states that the 4th respondent will decide the objections dt.17.12.2019, filed by petitioners within a period of two (02) months from the date of receipt of copy of the order.

Accordingly, the Writ Petition is disposed of directing the 4th respondent to decide the objections dt.17.12.2019 submitted by petitioners within a period of two (02) months from the date of receipt of copy of the order after giving notice to respondents and affected persons; and till such objections are decided, no allotment shall be made by respondents of any 2 BHK houses in the area of Pinapaka Village, Thallada Mandal, Khammam District.

Accordingly, the Writ Petition is disposed of as above. No order as to costs.

As a sequel, miscellaneous petitions pending if any in this Writ Petition, shall stand closed.
