THE HONOURABLE SRI JUSTICE T.AMARNATH GOUD MACMA NO. 3449 of 2005 JUDGMENT:

This appeal is filed by claimant aggrieved by the order and decree dated 27.07.2004 in O.P.No.581 of 1999 passed by the Motor Vehicle Accidents Claims Tribunal-cum-I Additional District Judge, Nizamabad (for short 'the tribunal).

The order passed by the tribunal is well considered in all aspects, but the tribunal has not granted for extra nourishment and transport charges and hence, Rs.3,000/- towards extra nourishment and Rs.2,000/- towards transport has been granted. Thus, the claimant is entitled for Rs.Rs.90,000/- (Rs.85,000/- + Rs.3,000/- + Rs.2,000/-). The enhanced compensation shall carry interest @ 7.5% per annum from the date of petition till the date of realization.

In view of the above, the appeal is partly allowed. There shall be no order as to costs.
