THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER Writ Appeal No.107 of 2013 Judgment: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) This appeal, under Clause 15 of the Letters Patent, is preferred against the order passed by the learned Single Judge in W.P. No. 1423 of 2013 dated 22.1.2013.

The appellants herein are the petitioners in the writ petition which was filed seeking a direction to respondent Nos. 3 to 4 to initiate steps to delete the name of ineligible persons (590) in number from the provisional voters' list of the Territorial Constituencies 1 to 13 of the 2nd appellant-society in the proposed election.

The elections to the society were scheduled to be held in February, 2013. As the elections to the society must have already been held, and as no interim order was passed in the writ appeal, it is evident that the cause in the writ appeal does not survive necessitating any adjudication by this Court. The writ appeal fails and is, accordingly, dismissed. Miscellaneous Petitions pending, if any, shall also stand dismissed. There shall be no order as to costs.
