THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY I.A. No.2 of 2018 and SECOND APPEAL No.611 of 2009 JUDGMENT:

This appeal is filed under Section 100 of CPC, by the defendant, assailing the judgment and decree dated 04.3.2009 passed in A.S.No.111 of 2007 on the file of the Court of II Additional District Judge, Guntur, wherein and whereby the judgment and decree dated 01.3.2007 passed in O.S.No.2033 of 2005 on the file of the Court of II Additional Junior Civil Judge, Guntur, dismissing the suit for permanent injunction, was reversed.

I.A. No.2 of 2018 is filed by the respondent-plaintiff to record the compromise in terms of agreement of compromise. The agreement of compromise is filed along with the petition. 3.

The appellant is present. Sri T.S. Anand, learned counsel for the appellant identified the appellant in the open court. The respondent is present.

Ms.Nimmagadda Revathi, learned Advocate, representing Sri Nimmagadda Satyanarayana, learned counsel for the respondent, identified the respondent in the open court.

This Court read-over and explained the terms of the compromise to the appellant and the respondent, who in turn admitted the same as true and correct. In view of the same, this Court is inclined to record the compromise.

Accordingly, I.A.No.2 of 2018 is ordered. Consequently, the second appeal is disposed of, in terms of the compromise. Miscellaneous Petitions, if any, pending in this appeal shall stand closed.
