HON'BLE Dr. JUSTICE B.SIVA SANKARA RAO C.R.P. Nos.4779 & 4780 OF 2016 ORDER:

The Judgment Debtor (J.Dr) impugning the orders of the learned Principal District Judge, Nalgaonda District at Miryalaguda in E.P. Nos. 3 and 4 of 2014 in O.S. Nos. 48 and 49 of 2011 dated 22.08.2016 respectively under Order XXI Rules 37 and 38 C.P.C in issuing arrest warrant for recovery of respective decretal amounts with costs and expenses, maintained the two revisions respectively. 2) Heard both sides at length and perused the material on record.

3) Prima facie, there is nothing to admit or to grant any blanket stay but for giving liberty to the J.Dr to liquidate the respective decree debts in both the matters. The J.Dr shall pay 25% of the respective warrant amount within six weeks from today and the remaining 75% including the subsequent interest and costs, further, if any, for the full satisfaction shall be liquidated in 6 months in five equal monthly installments, if any default enables the Decree Holder (D.Hr) to enforce the warrants pending and in the case of compliance by virtue of this order, the two arrest warrants can be under suspension for 6 1⁄2 months from today. 4) Accordingly and in the result, both the revisions are disposed of. No order as to costs.

5) Consequently, pending miscellaneous petitions, if any, shall stand dismissed.
