HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.31274 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the action of the respondents in refusing to issue original certificate of 'Master of Surgery in ENT' to the petitioner, even though she had successfully completed the course in the year 2015 from the 2nd respondent-College as illegal and arbitrary.

2. Heard Srs.Manchikalapati Renuka, learned counsel for the petitioner, Sri Tadi Nageshwar Rao, learned Standing Counsel representing the first respondent and the learned Government Pleader for Medical & Health, representing the third respondent.

3. Both the counsel submitted that the issue involved in this writ petition is squarely covered by the judgment of this Court dated 20.06.2014 in W.P.No.16313 of 2014.

4. In view of the same, this Writ Petition is allowed, in terms of the order dated 20.06.2014 in W.P. No.16313 of 2014, directing the respondents to forthwith release the original Certificate of 'Master of Surgery in ENT' to the petitioner. There shall be no order as to costs.

5. Consequently, miscellaneous petitions pending, if any, shall stand closed.
