THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.8647 OF 2004 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the action of the respondents in not fixing the pay of the petitioner in pursuance of the Circular No.89 of 1992, dated 08.09.1992 issued by the Corporation as illegal, arbitrary, unjust and consequently direct the respondents to fix the pay of the petitioner by adding increments and pay the same to the petitioner.

The only grievance of the petitioner is that the respondents have not considered his case in pursuance of the Circular dated 08.09.1992.

The learned Standing Counsel for the respondents submitted that if the petitioner submits a representation, the same will be considered in accordance with law.

In view of the submissions made by learned counsel for both parties, the petitioner is hereby directed to submit a representation to the respondents. If the petitioner submits such a representation, the respondents are hereby directed to dispose of the same in terms of the Circular dated 08.09.1992 within a period of three (3) months from the date of receipt of the representation.

Accordingly, the Writ Petition is disposed of. No costs. Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
