THE HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.8482 of 2019 ORDER:
This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by petitioner/A1, seeking to grant anticipatory bail to him in Cr.No.807 of 2019 on the file of KPHB Colony Police Station, Cyberabad District, registered for the offences under Sections 420 and 406 IPC.

Heard learned counsel for the petitioner/A1, learned Additional Public Prosecutor representing the respondent-State and perused the record.

It is alleged in the complaint that after the death of the father of the de-facto complainant, the petitioner/A1 induced and promised her to provide a job as she is handicapped and he took her original education certificates, ATM, passbook, cheque books and also an amount of Rs.30 lakhs through ATM and cheques and that her relatives i.e., A2 to A5, took share in the said amount, later, the accused postponed the matter on one pretext or the other, thereby cheated her.

Learned counsel for the petitioner/A1 submits that as the defacto complainant was indebted to several persons for the prolonged treatment of her father for cancer, the petitioner/A1 stood as an elder person to resolve the dispute and thereafter, the de-facto complainant had transferred the service benefits of her father to the account of the petitioner, who in turn transferred the amounts to the creditors at her instance. He further submits that the petitioner hails from respectable family and he never involved in any crime and he is
ready to cooperate with the investigation and he shall abide by any condition imposed by this Court.

Learned Additional Public Prosecutor opposed the relief sought in the petition.

As seen from the contents of the FIR, after demise of the father of the de-facto complainant, her relatives and the petitioner/A1 have colluded with each other and induced her on the false promise that they would provide a job to her as she is handicapped and A1 had collected her original Education Certificates, ATM, passbook, cheque books and also took a sum of Rs.30 lakhs through ATM and cheques and that her relatives i.e., A2 to A5 also took share in the said amount. Accordingly, the petitioner/A1 along with A2 to A5 cheated and committed breach of trust with the de-facto complainant. Thus, in view of the nature of allegations leveled against the petitioner/A1, I am not inclined to grant anticipatory bail to him and his prayer for anticipatory bail is rejected. 7.
Hence, the Criminal Petition is dismissed.

Miscellaneous applications, if any pending in this criminal petition, shall stand dismissed.
