HON'BLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION No.28606 of 2019 ORDER:

This writ petition is filed seeking Mandamus to declare the action of the respondents, particularly respondent Nos.3 and 4, in interfering with the petitioner's possession and enjoyment over the land to an extent of Acs.5-00 guntas in Sy.No.5/18, situated at Addaghat Village, Routha Sakepalli Gram Panchayat, Asifabad Mandal, Komarambheem District, without following due process of law, without issuing any notice to the petitioner and without any authority under law, as illegal and arbitrary.

Heard Sri Lonkala Sridhar, learned counsel for the petitioner, and the learned Government Pleader for Forests appearing for the respondents.

Learned Government Pleader for Forests appearing for the respondents submits that while verification of the Revenue records was going on, a joint survey was conducted wherein it was found that the subject land, over which the petitioner is making a claim, comes under Reserved Forest area. However, the learned Government Pleader for Forests fairly submits that the authorities will once again conduct a joint survey of the subject land by issuing notice to the

TVK,J W.P.No.28606 of 2019 petitioner so as to dispel any apprehension being entertained by the petitioner.

Having regard to the said submission, this writ petition is disposed of directing the respondents to issue notice to the petitioner and conduct a joint survey strictly by adhering to the procedure prescribed under law and take appropriate action in accordance with law. This entire exercise shall be completed as expeditiously as possible, preferably within a period of three months from the date of receipt of a copy of this order. Status quo obtaining as on today with regard to possession over the subject land shall be maintained till then. No order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
