Order:
This Company Application is filed under Section 454(4) & (5A) of the Companies Act, 1956 (for short 'the Act'), for (i) taking cognizance of the offence committed by the accused under those Sections; (ii) summoning the accused for being tried and punished in accordance with sub-section (5) of Section 454 of the Act for having willfully and deliberately not complied with the requirements of sub- sections (1) to (3) thereof; and (iii) dispensing with the presence of the complainant during the hearing of the above complaint.
After accused No.1 has filed the statement of affairs, the Official Liquidator has filed several reports
pointing out various defects. The case was adjourned from time to time to enable accused No.1 to rectify those defects.
Today, at the hearing, Mr.J.Srinath Reddy, learned Counsel for the Official Liquidator, submitted that at long last, accused No.1 is able to rectify all the defects and that therefore, the Company Application may be closed. In the light of the above facts, this Company Application is closed.
